1. Acceptance of Terms
By accessing or using the Tynkl.net website (including all content, uploads, user submissions, creator pages, referral links, subscription tools, and all other features available through tynkl.net, collectively referred to as “Tynkl.net,” the “Website,” or the “Service”), you agree to be bound by these Terms and Conditions (the “Agreement”) and by Tynkl.net’s Privacy Policy, which is incorporated herein by reference.
If you do not agree to these Terms, you must immediately stop using the Website.
Tynkl.net reserves the right, at its sole discretion, to modify, update, or revise these Terms at any time. Continued use of the Website following any such changes constitutes your acceptance of the updated Terms. If you do not agree to any future changes, do not continue to use the Website.
These Terms apply to all users of Tynkl.net, whether registered members, creators, subscribers, or visitors, and you may only use the Website if you are legally able to enter into this Agreement under applicable law.
2. Description of Service
Tynkl.net is an online platform that allows registered and unregistered users to upload, share, view, and subscribe to content, including user-generated videos, images, comments, messages, creator pages, and other materials (“Content”). The Website may also provide referral links, affiliate-style tracking, and subscription-based creator monetization tools.
Tynkl.net may include links to third-party websites not owned or controlled by Tynkl.net. Tynkl.net assumes no responsibility for the content, privacy policies, or practices of any third-party sites and disclaims all liability arising from your use of them.
Tynkl.net is intended for personal, non-commercial use only unless expressly authorized in writing by Tynkl.net. Any unauthorized or illegal use, including but not limited to data scraping, framing, automated access, referral fraud, payment manipulation, or sending unsolicited communications, is strictly prohibited.
3. Access Eligibility
By using Tynkl.net, you affirm that you are at least eighteen (18) years of age or older and are above the age of majority in your jurisdiction.
If you are under 18, or under the legal age of majority where you live, you may not access or use the Website.
If you register as a creator, you represent and warrant that you are legally permitted to enter into this Agreement, receive payments, and provide the Content you upload or publish on the Website.
4. User Conduct
You are solely responsible for your user submissions and any consequences arising from posting, uploading, linking, referring, or otherwise making content available on Tynkl.net.
You agree not to post, upload, transmit, refer, or make available any content or activity that:
- Is illegal, unlawful, threatening, abusive, harassing, defamatory, obscene, fraudulent, misleading, or otherwise objectionable;
- Infringes upon another’s intellectual property or privacy rights;
- Contains personal or identifying information about others without consent;
- Contains viruses, malware, bots, scripts, or any software designed to harm, disrupt, manipulate, or monitor devices or systems;
- Violates any local, state, national, or international law;
- Depicts or promotes illegal activities, self-harm, animal cruelty, or physical violence;
- Attempts to manipulate subscriptions, referrals, commissions, views, clicks, or payouts through automated means, fake accounts, chargebacks, stolen payment methods, impersonation, or any deceptive activity; or
- Attempts to bypass, disable, interfere with, or exploit the Website’s tracking, billing, payout, or security systems.
You further agree not to use Tynkl.net in any manner that could expose the Website to civil or criminal liability.
Tynkl.net reserves the right, at its sole discretion, to determine whether content or behavior violates these Terms and to take appropriate action, including removal of content, suspension of accounts, withholding of payouts, reversal of commissions, and termination of access.
5. Creator Program and Subscription Revenue Share
Tynkl.net may offer eligible creators the opportunity to earn compensation based on subscription revenue generated from subscribers who sign up through the creator’s referral link, creator page, embedded link, or from a creator’s video or other trackable promotional content (the “Creator Program”).
Unless otherwise stated in a separate written agreement, eligible creators will earn ten percent (10%) of the net subscription fees actually received by Tynkl.net from qualifying subscribers attributed to that creator, subject to the terms of this Agreement.
For purposes of this Agreement, “net subscription fees” means the subscription amounts actually collected by Tynkl.net from a qualifying subscriber, excluding refunds, chargebacks, taxes, payment processing fees, currency conversion fees, fraud losses, bad debt, discounts, promotional credits, and any other amounts withheld, reversed, or retained by payment processors or required by law to be deducted.
Tynkl.net shall have sole discretion to determine whether a subscription is properly attributed to a creator, including the attribution method, tracking window, and whether the subscriber qualifies for commission.
Creators acknowledge and agree that:
- Commissions are only payable on eligible, valid, and successfully collected subscription payments;
- No commission is earned on refunds, partial refunds, failed payments, disputed payments, chargebacks, fraudulent transactions, or subscriptions obtained in violation of these Terms;
- Tynkl.net may adjust, delay, suspend, withhold, or reverse payouts if fraud, abuse, error, or policy violations are suspected;
- Tynkl.net may set minimum payout thresholds, payout schedules, and administrative requirements for participation in the Creator Program; and
- Tynkl.net may change the Creator Program terms, payout structure, or attribution rules at any time, subject to notice where required by law.
If a creator receives any overpayment, duplicate payment, or payment made in error, Tynkl.net may recoup, offset, or deduct the overpaid amount from future payouts, to the extent permitted by law.
Participation in the Creator Program does not create an employment, partnership, agency, fiduciary, or joint venture relationship between you and Tynkl.net.
6. Creator Verification, Tax, and Payment Terms
Creators may be required to provide identity verification, tax forms, payment information, age verification, and any other information reasonably requested by Tynkl.net before receiving payouts. Tynkl.net may use third-party vendors to verify identity, detect fraud, and process payments.
You agree to provide accurate, current, and complete information at all times. You are solely responsible for maintaining and updating your account and payout details.
You are solely responsible for all applicable taxes, reporting obligations, and governmental filings arising from payments received through the Creator Program. Tynkl.net may withhold taxes or other amounts where required by law.
Tynkl.net is not responsible for delays caused by payment processors, banks, verification failures, compliance reviews, chargebacks, suspected fraud, or circumstances outside its reasonable control.
7. Fraud, Abuse, and Enforcement
Tynkl.net strictly prohibits fraud, abuse, deceptive practices, and manipulation of the Website or Creator Program. This includes, without limitation:
- Creating fake accounts, fake subscribers, fake referrals, or fake traffic;
- Using bots, click farms, scripts, automated systems, or other artificial means to generate subscriptions, views, or commissionable activity;
- Using stolen payment methods or unauthorized payment instruments;
- Self-referrals, circular referrals, or other attempts to generate commission through your own account or related accounts unless expressly permitted in writing;
- Misrepresenting the source, ownership, or authenticity of traffic or subscribers;
- Chargeback abuse, refund abuse, or intentional dispute abuse;
- Impersonation, identity fraud, account takeover, or concealment of identity for payout purposes;
- Any attempt to exploit referral tracking, attribution systems, or payout calculations.
If Tynkl.net suspects fraud, abuse, or policy violations, it may, at its sole discretion and without prior notice, suspend or terminate accounts, withhold or cancel payouts, reverse commissions, remove content, and take any other action it deems appropriate, including cooperating with law enforcement or payment processors.
Tynkl.net may investigate suspicious accounts or transactions and may require additional verification before releasing funds.
8. Intellectual Property Rights
Except for User Submissions, all materials on Tynkl.net—including text, graphics, software, music, videos, photos, trademarks, service marks, and logos—are owned by or licensed to Tynkl.net and are protected by copyright and intellectual property laws.
Content provided on Tynkl.net is made available “as is” for personal, non-commercial use only unless otherwise expressly authorized. You may not copy, distribute, transmit, display, sell, license, or exploit any portion of the Website or its Content without prior written consent from Tynkl.net or the respective rights holder.
If you download or print any Content for personal use, you must retain all copyright and proprietary notices.
You may not circumvent or disable any security features, tracking features, or restrictions on the Website.
9. Zero Tolerance Policy
Tynkl.net enforces a zero-tolerance policy toward illegal content. The following materials are strictly prohibited:
child sexual abuse material (CSAM), bestiality, rape, torture, “snuff,” or any other obscene or illegal depictions.
Tynkl.net fully cooperates with law enforcement and government agencies in investigating and prosecuting violations related to such content.
10. User Warranties
You represent and warrant that all information you provide to Tynkl.net is accurate, current, and complete, and that you have the legal authority to enter into this Agreement.
You further represent and warrant that you own or have obtained all rights, licenses, consents, and permissions necessary to upload, publish, distribute, and monetize any User Submission or promotional content you provide, including any content used to generate creator commissions.
You also acknowledge that Tynkl.net may transmit data, including User Submissions, over various networks and may adapt such data to meet technical requirements.
Data collected by Tynkl.net is handled in accordance with the Privacy Policy.
11. Disclaimer of Warranties
Your use of Tynkl.net is at your own risk.
To the fullest extent permitted by law, Tynkl.net and its officers, directors, employees, and agents disclaim all warranties—express or implied—including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
Tynkl.net makes no warranties regarding the accuracy or completeness of any content and is not responsible for:
- Errors, inaccuracies, or omissions in content;
- Personal injury or property damage resulting from use of the Website;
- Unauthorized access to or use of servers or stored data;
- Transmission interruptions or service failures;
- Viruses, malware, or harmful components transmitted by third parties; or
- Any loss or damage resulting from the use of content posted or shared on the Website.
Tynkl.net does not endorse or guarantee any third-party products, services, links, or payment outcomes advertised or linked through the Website.
12. Limitation of Liability
To the maximum extent permitted by law, Tynkl.net, its affiliates, officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages resulting from your use of or inability to use the Website or its content.
This includes but is not limited to damages arising from errors, interruptions, data loss, unauthorized access, payout delays, withholding of funds, reversed commissions, fraud investigations, or third-party conduct.
You acknowledge that Tynkl.net is not responsible for User Submissions or for the actions of any third party.
13. Indemnification
You agree to defend, indemnify, and hold harmless Tynkl.net, its affiliates, officers, directors, employees, and agents from and against all claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of:
- Your use of or access to the Website;
- Your violation of these Terms;
- Your violation of any third-party rights;
- Your fraud, misrepresentation, abuse, or unlawful conduct;
- Any claim that your User Submission or promotional activity caused harm to another party; or
- Any tax, payment, or regulatory issue arising from your Creator Program participation.
This obligation survives the termination of these Terms and your use of the Website.
By using Tynkl.net, you affirm that you are legally competent and authorized to enter into this Agreement.
14. Termination and Suspension
Tynkl.net may, at any time and in its sole discretion, suspend, restrict, or terminate your account, creator status, access to the Website, or participation in the Creator Program, with or without notice, for any reason or no reason, including if Tynkl.net believes you have violated these Terms, engaged in fraud, created risk, or harmed the Website, its users, advertisers, subscribers, or payment systems.
You may stop using the Website at any time. Termination does not relieve you of obligations incurred before termination, including payment obligations, tax obligations, indemnification, confidentiality obligations, and any obligations relating to fraud, withheld funds, chargebacks, or reversed commissions.
Upon termination, Tynkl.net may retain, delete, or disable access to any data or content in accordance with its policies and applicable law. Any unpaid commissions may be forfeited or withheld where permitted by law and where necessary to offset refunds, chargebacks, fraud, or other losses.
15. Assignment and Severability
You may not assign or transfer your rights or obligations under these Terms without prior written consent from Tynkl.net. Tynkl.net may assign its rights and obligations freely.
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
16. Miscellaneous
These Terms constitute the entire agreement between you and Tynkl.net regarding the Website and supersede any prior or contemporaneous understandings, whether written or oral, except as expressly stated in a separate signed agreement.
Tynkl.net’s failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or any other provision.
